Privacy statement and terms of use

1. Terms

La Trobe University, ABN 64 804 735 113 (LTU), through its Australian Research Centre in Sex, Health and Society (ARCSHS), makes available to you, in accordance with these terms of use (Terms), its website, contents, and scale known as PozQoL (PozQoL). Your use of PozQoL constitutes your acceptance of these Terms. You warrant to LTU that you are authorised to enter into these Terms. If you do not agree to the Terms you must cease using PozQoL.

2. Licence to PozQoL website and PozQoL Scale Documents

LTU grants to you a limited, personal, non-transferable, revocable, non-commercial licence to access and use the PozQoL website and contents on devices owned or controlled by you for the purpose of using and implementing the PozQoL Scale. Where documents and contents on the PozQoL website are offered for download (the PozQol Scale Documents), those PozQoL Scale Documents are offered for use under a Creative Commons Attribution- Non-Derivatives License. The relevant terms can be located at http://creativecommons.org/licenses/by-nc-nd/4.0/

3. Commercial use

The PozQoL website and the PozQoL Scale Documents are offered for non-commercial and academic use only and must not be used for any commercial use. If you wish to use PozQoL for any commercial purposes, contact the PozQoL Team at pozqol@latrobe.edu.au for further information.

4. Privacy

LTU handles personal information in accordance with LTU’s Privacy Policy and Procedure, a copy of which is available at: www.latrobe.edu.au/privacy or by contacting the PozQoL team at pozqol@latrobe.edu.au or LTU’s Privacy Officer at privacy@latrobe.edu.au. You consent to LTU (or a third party authorised by LTU, including any third-party hosting or other service providers engaged by LTU) using any personal information supplied by you, or on your behalf, to LTU for the primary purposes of administering and supplying goods or services to you in relation to PozQoL.

5. PozQoL ownership

Ownership of intellectual property rights in PozQoL and the PozQoL Scale Documents — including the website and all software, content, images, data, tools, methodologies, algorithms, code, documentation, analytics, enhancements, modifications, trademarks, logos, or any other content in PozQoL and the PozQoL Scale Documents — vests and remains vested in LTU. Unless otherwise expressly stated, you must not directly or indirectly, copy, recreate, imitate, resell, transfer, modify, decompile, reverse engineer, or distribute to any other person PozQoL or its content, in whole or in part, nor permit any person to do so.

6. Citation

In addition to any terms downloaded from the website, if you produce any written works or other media related to your use of PozQoL, you must cite PozQoL using the following reference:

7. Cookies, local storage, and web analytics

Cookies and local storage values are small data files that are transferred to your web browser when you visit a website. These files contain pieces of information that help you navigate a website efficiently and also help LTU with statistical information to facilitate general web site management, development, and planning.

Cookies and local storage values store non-personal information such as (but not limited to) the server address and domain name of your internet service provider, date and time of your visit to the site, which pages you accessed on the PozQoL website, files you downloaded, address of the last site you visited, and the type of browser you are using.

From time to time, LTU may use third party web analytics and marketing technologies to collect information about your interaction and usage of our websites.

You can refuse to accept the use of cookies by adjusting the settings on your web browser; however, doing so may result in you not being able to use the full functionality of this website.

8. Suspension

LTU may at any time (without notice and for any reason) remove or suspend access to  PozQoL, including for the purpose of carrying out any updates or maintenance to PozQoL, where LTU ceases to publish or make available PozQoL or any part of PozQoL, where LTU suspects PozQoL may infringe the intellectual property or any other right of any person or violate any laws, or where LTU suspects you may otherwise be in breach of these Terms.

9. Changes

LTU reserves the right to update or modify PozQoL or amend any of these Terms at any time in its sole discretion by publishing such changes on or through PozQoL. LTU may also elect to advise you of such changes from time to time in writing. If you do not agree these changes, you must cease using PozQoL. Your continued use of PozQoL constitutes your acceptance of these changes.

10. Governing law

These Terms are governed by the laws of the State of Victoria, Australia and each party submits to the exclusive jurisdiction of the courts of Victoria, Australia in relation to any matter arising from your use of the PozQoL or these Terms.

12. Disclaimer

LTU provides PozQoL “as is” and you acknowledge and agree that you use any outputs generated by PozQoL at your own risk.

LTU does not guarantee uninterrupted use or accessibility of PozQoL and, to the extent permitted by law, all warranties in respect of PozQoL — whether express, implied, statutory, or otherwise — are excluded.

To the extent permitted by law, LTU accepts no responsibility or liability for:

  • any loss, cost, or expense to you or any third party arising from your use of PozQoL or any outputs
  • any unavailability, loss, or corruption of any Content
  • unauthorised access to, or misuse of, any Content

Your sole remedy in respect of any such loss or liability is to cease using PozQoL. It is your responsibility to ensure you have backups of any outputs.

To the extent such warranties or liability cannot be excluded by law in relation to any goods or services supplied under this agreement, liability is limited at LTU’s option to supplying, or the cost of supplying, the relevant goods or services again.
